New Changes To Elevator Violation Corrections Process

The DOB recently announced changes for the elevator violations correction process – specifically for administrative violations like the EVCAT1, EVCAT5, and ACC1 (failure to file Category 1 and Category 5 inspections, and failure to file any required Affirmations of Corrections for inspections, respectively).

Like many of the DOB’s recent adjustments, this Service Notice shared that the corrections process has now moved entirely online. Previously, violation payments and waiver requests could be made in person. As of June 17th, 2020, you can pay civil penalties for these violations via DOB NOW: Safety (the same portal where elevator inspections and follow-ups are filed). Credit card payments will result in quicker clearances, while payments by eCheck may take up to 10 days to process.

In addition to violation payments, Civil Penalty Waiver requests have also moved to DOB NOW. “As of Wednesday, June 17, 2020, an Elevator Waiver of Civil Penalties Form (EWP) can no longer be sent by postal mail, emailed or delivered in person to the Elevator Unit.”

Once payment has been processed, the status of paid violations will update to dismissed. Please note that according to the DOB, “Violations from 2017 or later require a current CAT1 or CAT5 inspection report in accepted status to have been filed in DOB NOW: Safety. Once payment has been made, the violation will not be dismissed unless an accepted inspection report has been submitted. Once inspection reports are submitted, the status should be updated within 24 hours.”
