UPDATE: How to Confirm if Your Property is Required to Submit LL84 Reports This Year

While Local Law 133 of 2016 opened the door to properties over 25,000 having to submit LL84 reports, you may or may not be required to file just yet.

The Department of Buildings is preparing an update on which properties will be required to file their 2017 benchmarking data by May 1st of this year. According to the Department, many properties received a notice that they may be required to file. This is contrast to the DOF’s official notice in November quarterly statements, informing certain properties that they will be required to file.

Although the DOB’s official Benchmarking website shows (as of January 22nd) that buildings above 25,000 sq. ft. will be required to file during this cycle, we’ve been informed by the Department that the best ways to confirm if your building needs to file are via your Statement and the Covered Buildings List (CBL), set for release in February.

UPDATE FROM THE DOB: The Department has confirmed that if you’re included on this year’s CBL (check below to confirm your property) you will ultimately be required to file your 2017 Benchmarking data at some point. The key difference is your building size – properties 50,000 sq. ft + (any building that met the original requirements) must still file by May 1, 2018 to avoid penalties. Properties that are new to the CBL (25,000 – 49,999 sq. ft.) will be required to file their 2017 data at a future, to-be-determined date. The Department has stated that the due date is forthcoming, so stay tuned for news here.

With that said, the Department is encouraging mid-sized buildings to file by May 1st anyway – even though compliance by that date isn’t mandatory for the 25,000 sq. ft. group, the DOB says it’s a good way to make sure you’ve filed correctly for the first time.

Bottom line: If you’re on the list, you’re required to file 2017 data at some point – either May 1, or a future date to be determined.

So what should you do now?

  1. Check your November 2017 Statement (available in SiteCompli). If you’re required to file, there will be a page attached to the end of the statement denoting the same.
  2. Check the updated CBL in February (available here from the DOB, or in your SiteCompli account). Whether your due date is May 1 (50,000 sq. ft. and up) or not yet announced, you’ll be listed here if you ultimately have to file.
