What is the annual boiler inspection filing process?

  • The BO-9 inspection form must be filed within 14 days of performing the inspection (a change from the previous 45).
  • If defects are found during the inspection, they must be corrected and an Affirmation of Correction (BO-13) must be filed within 90 calendar days from the BO-9 inspection date. Reports are not considered complete until the BO-13 is filed, which must be submitted within 14 days of the correction date.
  • Reports submitted more than 180 calendar days from the BO-9 inspection date will incur a late penalty of $50/boiler/month.*
  • Reports submitted 12 months after the inspection date will be deemed expired and incur the full civil penalty/violation ($1,000).
  • Owners can request extensions based on the criteria outlined in RCNY 103-01 using a BO-13E

 

*Please note that this 180 day timeframe is based on previous rules. As of Jan 1, 2022, boiler reports are now due within 90 days and will be considered late/may face penalties if submitted after that period.
