What is an EVCAT5?

An EVCAT5 is an administratively issued violation for failure to file a Category 5 load-bearing elevator inspection. Because these violations are standard (not variable) and administratively issued, there are no associated copies.

The civil penalty for an EVCAT5 is $5,000 per noncompliant device. To resolve an EVCAT5, pay the full civil penalty with the Elevator Division at the Department of Buildings.

To challenge an EVCAT5, provide proof of the timely, filed, and complete Category 5 test along with a copy of the cancelled check for the inspection fee to the Elevator Division within 30 days of issuance of the violation. Alternatively, you can provide proof to the DOB that the device in question does not require the Category 5 load bearing test.

As of June 2020, fines for EVCAT5 violations must be paid online via DOB NOW. Waivers for civil penalties must also be paid online. See SiteCompli's Blog Post for more details.
