HPD Annual Safety Notice Mailings

Am I required to send annual safety notice mailings?

Per the law, multifamily landlords (3+ units) are required to send annual safety notice mailings each year. While Local Law 1/2004 only applies to properties built before 1960, or between 1960 – 1978 where the landlord knows lead paint is present, both lead paint and window guards appear on the city’s standard form, and are sent together. Window guard requirements (as noted on the form) apply to all buildings with 3+ units, regardless of when they were built.

Local Law 1/2004 does not apply in a dwelling unit where title is held by a cooperative or condominium and the shareholder of record or his/her family occupies the unit. It does apply to cooperative or condominium units occupied by a tenant or subtenant. That said, window guard information is still needed for cooperatives (and still must be installed and maintained by management), which is why cooperative managers fulfill the annual safety notice mailing process.

Additionally, fire safety guides are required for all Group R-2 properties, with exceptions for R-1 transient lodging (404.2.1(8)), and school/college dorms (unless required by FC408.10). Condo/co-op boards are specifically listed as responsible for preparation/distribution of fire safety guide, in addition to common-area postings.
