What is the Emergency Repair Program (ERP)?

HPD’s Emergency Repair Program is an extra layer of enforcement for Class C immediately hazardous violations. HPD reserves the right to refer uncorrected Class C violations to the ERP, where approved contractors submit open market order bids to perform the required work. Costs for repair are then billed to the property owner via their taxes/DOF Statement of Account. Failure to pay the same may lead to tax liens on the subject property.

Please note that in addition to Class C violations, the City notes that housing-related orders, DOB violations and orders, and DOHMH lead-based paint orders may also be subject to the ERP. An example of this is Local Law 101 of 2015, which permits the referral of immediately hazardous DOB-ECB elevator violations to the ERP. Outstanding ERP charges can prevent violation certification, Dismissal Requests, Violation Reissuance, and more, so it’s critical to avoid ERP charges and pay any overdue balances.
