Boilers must be officially decommissioned with the Department by filing an OP-49 form within 30 days of boiler removal. Owners may be charged $50/month or $500/year for late filings.
Please note: the DOB maintains that any violations incurred due to a late filing of an OP-49 are the responsibility of the owner. This means that administratively issued violations for failure to file inspections may still count even though the boiler didn’t physically exist. It’s imperative to file the OP-49 within 30 days of removal to prevent costly penalties.
