Certain DOB Penalties Waived Due To CrowdStrike Outage

A new Service Notice announced that certain DOB penalties are waived due to the recent CrowdStrike outage. Here’s what you need to know:

Timeframe For Waived Penalties

DOB NOW: Safety was unavailable on July 19, 2024 and intermittently available from July 20th – 21st. As a result, the DOB has decided to waive penalties for filings that were due during this limited timeframe:

Accordingly, the Department will waive civil penalties for failure to submit Elevator, Boiler, Façade, or Parking Structure inspection reports on one of those dates, provided the inspection report is submitted in DOB NOW: Safety no later than July 31, 2024.

Here’s how that breaks down for different inspection types:

Elevators and Boilers

  • The DOB will issue refunds to owners whose elevator and/or boiler inspection reports were due on July 19th, 20th, or 21st, and who pay a civil penalty in DOB NOW: Safety based on the failure to submit on the designated above date.
  • Refunds will only be issued if the inspection report is submitted in DOB NOW: Safety no later than July 31, 2024.

Facades & Parking Structures

Parking structures are especially important, as the one-time initial observation for many structures is due August 1, 2024, and the outage may have impacted a number of teams attempting to file before the due date.

  • Owners who received violations for failure to file inspection reports or failure to correct unsafe conditions, and believe they are entitled to a full or partial waiver because the report was due or time extension ended from July 19th – July 21st, may submit a civil penalty request waiver in DOB NOW: Safety.
  • There will be a new Waiver Request Reason available in DOB NOW: Safety to select for this reason.
  • The DOB will issue additional Service Notices with more information and waiver submission instructions before said facade and parking structure violations are issued later this year.
