Managing Pool Permits at NYC Properties

If you’re managing a NYC property with a pool or spa, make sure you’re on top of annual permit requirements. Here’s a rundown of what you need to know for pool compliance in the city.

Pool Permit Renewal Process

Permits are required to operate most pools in the five boroughs, including those at schools, in hotels, multifamily buildings, condos, clubs, gyms, and more. The only exceptions are:

  • 1-2 family homes and for noncommercial use by the home’s residents (meaning – you can’t rent out your pool to paying guests without a permit)
  • A float tank or relaxation tank designed for single use
  • Pools used for religious purposes/ritual immersion
  • Spas used for medical therapy or rehab under medical care

Expiration dates for all pools in NYC are the same – April 30th each year for annual permits, and November 1st each year for seasonal permits.

Renewal is required annually, with a $245 fee. Renewals can be processed online, in person, or by mail. You can start the process here at the DOHMH’s website.

Per the Department, renewals do require the agency checking if the pool is safe and stable, and having an architect or engineer check safety when the pool is empty and full.

What if we want to install a new pool?

The application process for a new permit has quite a few more steps. To start, you must contact the DOHMH Office of Public Health Engineering for “help with your documents and plans.” If you have questions, you can reach out to them at phe@health.nyc.gov or 718-786-6004.

Several forms and plans must be submitted, and additional permits (sewer discharge, subsurface connection approvals, underwater light approvals) must be obtained. You must also obtain a Certificate of Occupancy from the DOB approving pool/bathing establishment use. You can review each step and start the process on the website here under How To Apply.

Bathing Establishments – No Pool

Bathing establishments without a pool (steam rooms, saunas, spray grounds) also have ongoing compliance requirements. While initial application process has fewer steps, the renewal process is similar. Renewals are required annually, with a $260 fee. You can begin the process on their website.

That said, it’s important to make sure you’re following all the applicable rules. Per the DOHMH:

Getting a permit from the NYC Department of Health and Mental Hygiene (DOHMH) does not cover all rules. You must also get other permits and licenses from other City and State Agencies. If you do not follow all rules, your DOHMH permit may be suspended until you do.
