DOB Boilers and Facades

What happens if my façade is classified as unsafe?

Owners with an Unsafe filing must immediately commence repairs/reinforcements, and install protection (sidewalk sheds, safety netting, or construction fences) to prevent harm to the public.

All unsafe conditions must be corrected within 90 days from the submission of the critical examination report.

If repairs are unable to be completed within that timeframe due to the scope, the QEWI performing the inspection must "recommend a time frame for repairs to be performed to bring the building to SWARMP or safe status, and must indicate the date by which the work will be completed (MM/DD/YYYY). Time frames of more than five (5) years will not be accepted."

The QEWI must inspect the premises within two weeks after repairs have been completed. They must then promptly file a detailed amended report with the DOB. The building owner must also obtain any permit sign-offs, as appropriate.

Read more about unsafe conditions and extensions in the final promulgated laws (in effect 2.20.20) here.
