How do I resolve heat and hot water violations?

Heat and hot water violations must be resolved immediately, and self-certified via mail or eCertification. The Notice of Violation will state if the violation is eligible for $250 payment in satisfaction of civil penalties – either the first of the current or previous season for heat, or the first of the current or previous calendar year for hot water. If the check and Certification is not received within ten days of issuance/correction, then HPD may pursue additional civil penalties.

HPD may begin a court proceeding to collect civil penalties for heat and hot water violations, effective from the date of posting until the date of correction:

  • $250-$500 dollars per day for each initial heat or hot water violation
  • $500-$1,000 per day for each subsequent violation at the same building during the same and/or the next calendar year from the initial violation or, in the case of § 27-2029(a), during the same and/or the next heat season

It’s critical to know as soon as heat and hot water-related complaints are filed so you can resolve the issue immediately and prevent violations. Heat and hot water violations can escalate quickly, so establishing a response plan is imperative.
