How do I resolve lead-based paint violations?

Requirements for correction depend on the Order Number of the given violation:

  • Order #616 – Correct and certify the correction of the condition; file for a contestation; request a postponement – certification form here
  • Order #617 – Correct and certify the correction of the condition – certification form here
  • Order #618 – Provide requested records within 45 days of demand. You can contact the lead-based paint inspection unit’s COTA Unit at (212) 423-5065 for more details regarding the dismissal of this violation.

You must also abide by the following rules for certification:

  • All work must be performed by an EPA licensed firm that follows all safework practices. Dust clearance testing must occur every day, and also at the conclusion of the work.
  • The EPA licensed firm must provide the following documentation, and provide the necessary documentation:
    • Sworn statement (sample here) that the work was performed in accordance with applicable laws
    • A copy of the firm’s EPA certification
    • A copy of the DOHMH Certificate of Training for the person performing the work
    • An affidavit from the person performing the dust sample, verifying the date the sample was taken and indicating the address/apartment where the sample was taken (sample here)
    • A copy of the NYS-certified laboratory analysis of all surface dust samples. You can find a list of certified labs here.

As an aside, the Department of Health and Mental Hygiene has a list of certain companies prohibited from performing lead paint testing, lead paint and dust analysis, or lead abatement work. You can access that list here.

All documents, including the certification, can be submitted to the address below. Once everything is approved, HPD will perform a re-inspection to dismiss the violation.
