Violations with overdue self-certification dates can be cleared via an HPD Dismissal Request. For a fee, HPD will send an inspector to verify corrections on outstanding violations. HPD requires access to specifically requested units, and will schedule up to two inspection appointments with property owners.
In the summertime, HPD attempts to perform inspections within 45 days of the request. During heat season (winter), Dismissal Requests may take up to 90 days to fulfill. Certain types of violations (lead paint-based infractions, for example) may also require additional paperwork on file, separate from a completed Dismissal Request.
Requests may be rejected in the case of pending HPD litigation, outstanding judgments, or unpaid ERP charges. Buildings in the AEP must contact the program office directly [(212) 863-8262] to schedule a Dismissal Request.

In fact, it’s fairly common to see a bulk amount of violations closed after a dismissal request, along with a few (or several) new violations issued during the inspection. It’s imperative to make sure your property is prepared once the inspection is scheduled, and any outstanding issues are resolved before an inspector arrives.
