What is Violation Reissuance?

Violation Reissuance is an HPD program utilized to clear specific overdue HPD violations. You can apply for this program using the Violation Reissuance Request form.

In order to qualify for reissuance, a building must have no violations over 12 months old, no falsely certified violations in the past 12 months, no unpaid ERP charges, no pending HPD litigation, and current property registration. Properties in the AEP are not eligible for reissuance, and lead-based paint violations are not reissued.

If approved, eligible violations will be “reissued” to the property with a new self-certification due date. At that time, you can eCertify or mail certifications for each violation as if they were newly issued.

Please note that HPD lists this program as one-time per property. There are no clarifying notes on whether or not this is one-time only, once per year, or any alternate frequency. With that said, it’s important to make sure you’re prepared to certify all eligible violations as soon as they are reissued. Failure to do so may require you to initiate a Dismissal Request to clear any additional violations.
