We’ve written several blog posts on the new gas regulations for NYC buildings. This update revolves around Local Law 153, a new requirement for residential owners and managers.
Per HPD, “Local Law 153 of 2016 requires the owner of a dwelling to provide residential tenants with a notice regarding procedures that should be followed when a gas leak is suspected.” Local Law 153 goes into effect on June 4, 2017.
Information for a gas leak must be provided in two ways:
- delivering notices to all prospective tenants and tenant-occupied units, including 1- and 2-family homes, with a lease or lease renewal form; and
- posting and maintaining a notice in a common area of the building
HPD has created a sample notice for your use. That said, they’ve also noted that HPD will update this notice and any associated language once the rule is final.
Still, it’d be wise to make sure this is posted in common areas and distributed as required before 6/4/17, when HPD inspectors will be able to issue violations for failure to comply.
