On February 9th, SiteCompli hosted a webinar with Prise NY to discuss some big compliance trends for 2023. New York’s compliance landscape is constantly changing – staying on top of these changes and thinking strategically about your team’s compliance operations this year is crucial to protecting your portfolio. Here are some highlights from the webinar:
Sanitation
The city is prioritizing sanitation protocols and ramping up enforcement this year. Between adjusted trash set out times and the introduction of the Multiunit Collection program, the DSNY is working to get the city’s rodent problem under control by reducing the time trash sits on the curb. DOB Filings
There are several new requirements and enforcements for the DOB.
Retaining walls
Owners of retaining walls that are 10+ feet and fronting a public right of way are required to hire a QRWI to inspect it once every 5 years. It’s important to note that the submission process is email based. Currently, we are in Cycle 2, which ends on December 31st, 2023 and covers Brooklyn. Click here to see other previous cycles.
LL152 – Gas Piping
This year is the final filing year for the first cycle of Local Law 152. Last year’s filing group was the first that wasn’t given a 6-month extension, so ensure you never count on extensions, because they are not guaranteed.
Another thing to keep in mind here is that these regulations are not just for properties with gas piping systems. There are also requirements for buildings with no gas piping systems or inactive/disconnected systems. If anything is overlooked, violations will follow. Fines for non-compliance range from $5000- $10,000. To see the date ranges for inspection, check out the DOB webpage.
Elevators
Last year was the first for new periodic inspections processes, and property managers taking on a more hands-on role. Instead of the DOB sending inspectors each year, you are responsible for managing the inspection process by hiring an authorized agency to perform annual periodic inspections. This is yet another critical task your team is responsible for, so make sure your team is aware of this change. Parking Structures
If your properties have parking structures, there are new rules that apply to you.
- A professional engineer must conduct an inspection once every 6 years
- Inspection reports are submitted via email
- Inspectors must repair unsafe conditions within 90 days and file amended report within 2 weeks
December 31st, 2023 is the first filing deadline for the first group, Community Districts 1-7 in Manhattan. The following group includes Manhattan districts 8-12 and all of Brooklyn. These cycles are two years, so the second group is not due until December 31st, 2025. Click here to see future parking structure filing cycles through 2027.
Sustainability
Local Law 97 is a big component of NYC’s sustainability efforts. It is an initiative to reduce greenhouse gas emissions in New York City. Under the new rules, most buildings over 25,000 square feet must meet new energy efficiency standards and comply with greenhouse gas emission limits by 2024. How you comply is dependent on the size and type of building, but it is never too early to start preparing. With huge impending fines for non-compliance, being reactive about your Local Law 97 response is critical.
