DSNY Trash Setout Adjustment For Community Boards

A new agency rule adjusts DSNY trash setout times by Community Board resolution. Here’s what you need to know about the newly adopted rule, going into effect on March 22nd.

Trash Setout Rules Now

Right now, residential properties have strict rules for trash setout:

  • For buildings with 1 – 9 units (bins required), and buildings with 10+ units using bins: waste must be set out after 6 PM
  • For buildings with 10+ units setting bags directly on the curb: waste must be set out after 8 PM

Bins must be 55 gallons or less with secure lids. Waste must be set out before midnight, unless specified otherwise by the Department. Failure to comply can result in fines.

Changes In The New Rule

For areas within sanitation districts that have collection scheduled for Saturdays, material may be placed out no earlier than 3 PM on Fridays, provided that:

  • Materials are placed out for collection in receptacles with a tight-fitting lid
  • Designated recyclable paper is tied and bundled securely without a container, and set out in accordance with the law
  • The Community Board for the community district in which the sanitation district is located has adopted a resolution requesting early Friday set out of solid waste or recyclable material for areas that have collection scheduled for Saturdays, as described in this paragraph, and submitted such resolution to the Department

The DSNY has 30 days to implement the alternate schedule within 30 days of a resolution being adopted. They will notify the Community Board Chair and District Manager of the effective date, and request that the Board notify residents of the district.

Based on the DSNY’s summary of the rule change, there are a few things they wanted to address:

  • Different needs of various communities
  • The recently amended Admin Code section 16-120(c)(4) (based on an agreement between NYS legislature and governor)
