UPDATE: DOB Rescinds All New AEUHAZ Violations – What’s Next?

The DOB has rescinded all new AEUHAZ violations issued in January 2026.

After issuing thousands of AEUHAZ violations citywide, the DOB has removed this issuance group completely. We recently reported on these violations, and the change in issuance timing from the DOB. This rescission makes tracking or predicting AEUHAZ violations even more complex going forward.

While we’ve confirmed this action with the DOB, we’re awaiting news on what to expect going forward. Will these violations be re-issued, potentially with the connecting DOB-OATH infraction? Or should we expect a return to the individually-based issuance period (issued within a certain timeframe for still-open violations, and not all at once citywide)? We’ll keep you posted if there’s any news here, so stay tuned.

Either way, it’s critical to ensure you can avoid these violations going forward:

  • Ensure an accepted Certificate of Correction (CoC) is on file for all DOB-OATH Class 1 violations
  • The DOB has said they have the right to issue AEUHAZ immediately for open Class 1 violations, but will likely issue them 30 days after the issue date
  • That said, the sooner a CoC is filed and accepted, the better – read the DOB’s instructions for submitting Certificate of Corrections here

Open AEUHAZ violations carry a $5,000 penalty separate from (and in addition to) the initial DOB-OATH penalty. Preventing them from being issued can stop these additional fines that sit directly on the building, as opposed to a named respondent.
