Several new rules for key agencies were recently proposed, with some finalized. Here’s what you need to know for DOB, DSNY, and HPD updates:
DOB Structural Fee Increases
The DOB just proposed new rules that would increase fees for key structural filings, including facades and parking structure reports. There are also a few adjustments regarding timing, and other filing details.
Amended filing fees will now be $940, with subsequent filing fees at $485 (same rate as initial filings). Requests of waiver for penalties for both facades and parking structure reports are $140. There will also be new fees for inspections necessary by failure to file compliance reports for parking structures, and parking structure verification requests – more on that below.
Parking Structure Eligibility
The new rules also include language on verification requests – specifically, where a QPSI can submit a request to the DOB to confirm whether or not a parking structure is subject to periodic inspection.

DSNY Commercial Waste Zone Rollout
DSNY finalized several clarifications to its Commercial Waste Zone rollout, along with two more zone implementation dates:
- Queens Northeast
- Brooklyn South
Both Zones are set to start on 1/1/26, and end implementation on 2/2/28. Outside of the expanded rollout, these rules also clarify requirements for Awardees when it comes to mergers, acquisitions, consolidations, and assignments. There’s also explicit language for assigning contracts if a business doesn’t comply by the final implementation date for their Zone (which may also result in a penalty), and specific details for contract terms.

XRF Challenge Rule Adopted
HPD has adopted amendments to rules focused on XRF test-related violation challenges.
Per the rule’s statement:
HPD’s amendments add a new section…to permit a registered owner, registered officer or director of a corporate owner or a registered managing agent of a multiple dwelling to challenge a violation issued…that is based on a positive XRF test result on a surface where the substrate is either metal or ceramic.

Rules Related To Basement/Cellar Dwellings
Two new rules related to basement & cellar dwellings were proposed – one to establish a temporary residence program, and the other to outline a right of return process.
