What is an EVCAT1?

An EVCAT1 is an administratively issued violation for failure to file a Category 1 annual elevator inspection. Because these violations are standard (not variable) and administratively issued, there are no associated copies.

The civil penalty for an EVCAT1 is $3,000 per noncompliant device. Violations dated prior to 2014 were issued once per building, and require a penalty sheet to determine impacted devices and the full civil penalty.

To resolve an EVCAT1, pay the full civil penalty with the Elevator Division at the Department of Buildings. To challenge an EVCAT1, provide proof of the timely, filed, and complete Category 1 test along with a copy of the cancelled check for the inspection fee to the Elevator Division within 30 days of issuance of the violation.

As of June 2020, fines for EVCAT1 violations must be paid in DOB NOW. Civil penalty waivers must also be filed in DOB NOW. Find out more in SiteCompli's Blog Post.
