A cure date may be offered by the FDNY to first-time offenders for certain Notices of Violation. If offered, the cure date will appear on the violation copy near the hearing date.
If a cure date is listed on the violation copy and this infraction is your first offense, you have the option of admitting guilt by submitting a Certificate of Correction to the FDNY. If the Certificate is Accepted by the FDNY, you will not have to attend the scheduled ECB hearing, and avoid any subsequent penalties. The violation will then have the status of “cured.”
If a violation lists a cure date but carries a mandatory hearing (noted on the copy), the named respondent will still have to appear at the hearing even if they correct the infraction in advance of the cure date.
Please note that if you do not submit a Certificate of Correction before the cure date, you are still required to submit one as proof of compliance. Failure to submit a Certificate of Correction will result in the violation remaining open in the FDNY’s records, and may lead to delays in future efforts to close the same. Because the hearing process and the corrections process are separate, you can submit a Certificate of Correction once the underlying conditions have been fixed.
