First DOB Parking Structure Inspection Violations Coming In November

The first set of DOB Parking Structure Inspection violations are being released in November 2024, per a recent Service Notice.

Per the Department, violations for Failure to File inspections within Subcycle 1A (parking structures in Manhattan community districts 1- 7) will officially be issued after an announcement made earlier this year. Subcycle 1A ended on December 31, 2023, with 1B (Manhattan 8 – 12, plus Brooklyn) ending on 12/31/25, and Subcycle 1C (all other districts) ending 12/31/27. Here’s what you need to know about the violations:

  • Violations will be issued in the form of DOB (non-OATH) violations, and carry a $5,000 per year penalty. We’re not sure if the DOB will issue subsequent violations for each year the report remains unfiled – we’ll let you know if there’s more information here
  • These Failure to File violations are separate from monthly late fees, which may have been assessed at the time of filing
  • Violations can be corrected via DOB NOW following the process on the Service Notice

It’s important to note – these are separate from violations for failing to file initial observations for Subcycles 1B and 1C, as required. While the DOB has announced violations for these, appearance of these infractions has not yet been independently observed by our team. It’s possible another Service Notice addressing these separate violations will be issued in the future.

The Council has already passed legislation increasing inspection frequency (from every 6 years to every 4 years), so we expect requirements to change at the end of Subcycle 1C in 2027.
